PLEASE READ THESE TERMS AND CONDITIONS (“Terms”) CAREFULLY BEFORE SIGNING THIS CONSENT FORM OR CHECKING THE DIGITAL CONSENT BOX. THESE TERMS CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU (THE “CUSTOMER”) AND MIZOAPEX BANK (THE “BANK”). BY PROCEEDING, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY.
These Terms are issued pursuant to and governed by the applicable provisions of:
- The Banking Regulation Act, 1949
- The Reserve Bank of India Act, 1934, and all RBI Master Directions, Circulars, and Guidelines issued thereunder
- The RBI Master Direction on Know Your Customer (KYC) Direction, 2016 (as amended)
- The Digital Personal Data Protection Act, 2023 (“DPDP Act”)
- The Information Technology Act, 2000, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011
- The Prevention of Money Laundering Act, 2002 (PMLA) and the Prevention of Money Laundering (Maintenance of Records) Rules, 2005
- The Credit Information Companies (Regulation) Act, 2005 (CICRA)
- The Foreign Exchange Management Act, 1999 (FEMA), where applicable
- Any other applicable statute, rule, regulation, or guideline issued by a competent authority in India from time to time
DEFINITIONS
Unless the context otherwise requires, the following terms shall have the meanings ascribed to them below:
TERM | MEANING |
Bank / Mizoapex Bank | Mizoapex Bank, a scheduled commercial bank incorporated under the laws of India, with its registered office at Aizawl, Mizoram. |
Customer / Data Principal | The individual who is a prospective, existing, or former account holder, borrower, or user of any product or service offered by the Bank. |
Personal Data | Any information that identifies or is reasonably capable of identifying a natural person, including but not limited to name, date of birth, address, contact details, PAN, Aadhaar number, and financial information, as defined under the DPDP Act, 2023. |
Sensitive Personal Data | Personal data pertaining to biometric data, financial data, health data, official identifiers (PAN, Aadhaar, Voter ID, Passport), and any other data notified by the Central Government under the DPDP Act, 2023. |
KYC | Know Your Customer — the process mandated by the RBI Master Direction on KYC (2016, as amended) for identifying and verifying the identity of customers. |
Consent | A free, specific, informed, unconditional, and unambiguous indication of the Customer’s agreement, given in writing, digitally, or through authenticated electronic means, to the processing of their Personal Data for the stated purposes. |
Data Fiduciary | Mizoapex Bank, in its capacity as the entity that determines the purpose and means of processing the Customer’s Personal Data, as defined under the DPDP Act, 2023. |
Third Party | Any entity other than the Bank and the Customer, including but not limited to service providers, credit bureaus, correspondent banks, technology partners, and regulators. |
ACCEPTANCE OF TERMS
The Customer represents and warrants that: (a) they are at least eighteen (18) years of age, or are a legally recognised minor represented by a parent, legal guardian, or natural guardian; (b) they possess the full legal capacity and authority to enter into these Terms; and (c) they are not acting under any undue influence, coercion, fraud, or misrepresentation.
The Bank confirms that prior to obtaining consent, the Customer has been provided with a clear and plain-language notice, in compliance with Section 5 of the DPDP Act, 2023, describing the purposes for which their Personal Data is being collected, the categories of data collected, and the Customer’s rights in relation thereto.
The Bank reserves the right to amend, update, or modify these Terms at any time, subject to prior notice of not less than thirty (30) days communicated to the Customer via registered e-mail, SMS, or notice published on the Bank’s official website (www.mizoapexbank.in). Continued use of the Bank’s services following such notice shall constitute acceptance of the revised Terms.
Important: If you do not agree to these Terms, please do not sign or submit this Consent Form and immediately inform the Bank. Declining consent may affect the Bank’s ability to offer certain products and services, as detailed in Section 5 of this document.
